Article1TheseProvisionsareenactedinaccordancewithArticle117andArticle211ofMaritimeCodeofthePeoplesRepblicofChina。

Article2TheseProvisionsshallapplytothecarriageofpassengersbyseabetweentheportsofthePeoplesRepblicofChina.

Article3Thelimitationofliabilityofthecarrierndereachcarriageofpassengersbyseashallbegovernedbythefollowing：

(1)Fordeathoforphysicalinjrytothepassenger：notexceeding40000yanRMBperpassenger;

(2)Forlossofordamagetothepassengerscabinlggage：notexceeding800yanRMBperpassenger;

(3)Forlossofordamagetothepassengersvehiclesincldingthelggagecarriedtherein：notexceeding3200yanRMBpervehicle;

(4)Forlossofordamagetothepassengerslggageotherthanthosedescribedinsb-paragraphs(2)and(3)above：notexceeding20yanRMBperkilogramofthelggage.

Ahigherlimitationofliabilitythanthatsetotinsb-paragraph(1)abovemaybeagreedponbetweenthecarrierandthepassengerinwriting.

Article4Inrespectofclaimsforlossoflifeorphysicalinjrytopassengerscarriedbysea，thelimitationofliabilityoftheshipownerthereofshallbeanamontof40000yanRMBmltipliedbythenmberofpassengerswhichtheshipisathorizedtocarryaccordingtotheshipsrelevantcertificate，btthemaximmamontofcompensationshallnotexceed21000000yanRMB.

Article5Thecompensationpaidtoforeigners，overseasChinese，compatriotsfromHongkong，MacaoandTaiwanmaybeconvertedintothecrrencyofthecontryorregionconcernedandtherateofexchangeshallbedecidedasperthelistedrateofexchangeofficiallypblishedbyforeignexchangecontrolathorityofthePeoplesRepblicofChinaonthedayonwhichthecompensationispaid.

Article6MinistryofCommnicationsofthePeoplesRepblicofChinashallberesponsiblefortheinterpretationoftheseProvisions.

Article7TheseProvisionsshallcomeintoforceasofJanary1，1994。
